1. Introduction
Mass Tort Agency LLC provides legal marketing solutions for attorneys. These Terms of Use govern your access to our website and related services. You must be at least 18 years old to access the Services.
2. Changes to Terms
We reserve the right to change and improve the features and functionality of the Services at any time. We may modify these Terms with notice, and your continued use indicates acceptance.

5. Lead Commitment Terms
5.1 Definitions
- Commitment Period: Twelve consecutive months from invoice payment date
- Lead Commitment: Total leads Mass Tort Agency agrees to deliver monthly
5.2 Delivery & True-Up
Mass Tort Agency uses commercially reasonable efforts to deliver monthly Lead Commitments. Monthly shortfalls carry forward to subsequent months. If unfulfilled within the Commitment Period, delivery extends accordingly.
5.3 Market-Volume Amendment
If available lead volume declines by more than 50%, Mass Tort Agency may amend the Lead Commitment.
5.4 Price Protection & Automatic Renewal
Pricing is guaranteed for the Commitment Period. Upon expiration, agreements auto-renew monthly unless clients provide 30 days' written notice.
5.5 No Warranty
Mass Tort Agency provides leads solely as an advertising service and makes no representation, guarantee, or warranty of any specific lead volume.
5.6 Governing Law
Governed by California law. Disputes resolve exclusively in Los Angeles County courts.
6. Consent to Electronic Communications
You consent to electronic communications from Mass Tort Agency satisfying legal notice requirements. You may withdraw consent by notifying the company.
7. Call Recording and Consent
Mass Tort Agency may record calls and communications related to Services. By accepting leads, participating in the Services, or receiving transferred calls, you automatically accept and are bound by these Terms.
Recordings serve quality control, compliance monitoring, training, and dispute resolution. De-identified or aggregated information may be used internally.
8. Third Party Websites
Mass Tort Agency does not control or endorse linked websites. We disclaim responsibility for third-party content, dealings, or promotions.
9. Prohibited Conduct
You may not:
- Impersonate persons or entities
- Engage in unauthorized data harvesting or scraping
- Access systems without authorization
- Collect personal data without consent
- Interfere with site operation or security
- Circumvent or reverse-engineer software
- Create excessive network loads
- Transmit viruses or harmful material
- Send unsolicited communications
- Violate laws or encourage illegal activity
10. Security
Violating the security of the sites or services is prohibited and may result in criminal and civil liability. Violations include unauthorized access, unauthorized monitoring, service interference, and system overloading.
11. Submitted Materials
By submitting content, you grant Mass Tort Agency a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive, and fully transferrable, assignable, and sub-licensable right and license to use such materials.
12. Intellectual Property
Unless otherwise provided in these Terms, Mass Tort Agency or its third-party licensors own all content on the sites. Content includes videos, text, graphics, code, design, and trademarks. Use grants no ownership claims.
13. Claims of Infringement
Mass Tort Agency respects intellectual property and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please contact us with the required DMCA notice information.
14. Indemnification
You agree to defend, indemnify, and hold harmless Mass Tort Agency and its affiliates from claims arising from your site access or use, Terms violations, or third-party right violations.
15. Disclaimers
Your use of the site is at your own risk. We make no representations or warranties about the operation of the site or the information, materials, goods, or services appearing on it. To the fullest extent permissible by law, Mass Tort Agency disclaims all warranties, express or implied.
16. Limitation of Liabilities
In no event will Mass Tort Agency be liable for damages or losses, including but not limited to consequential, indirect, incidental, punitive, exemplary, or special damages.
Mass Tort Agency's aggregate liability is capped at $100. Causes of action must begin within one year or be permanently barred.
17. Release
You release Mass Tort Agency from claims, demands, and damages arising from disputes with the company or other users. You waive all rights under California Civil Code § 1542.
18. Termination
Mass Tort Agency reserves the right, in its sole discretion, to restrict, suspend, or terminate these Terms and your access to all or any part of the sites or services, at any time and for any reason without prior notice or liability.
19. Severability
If any provision of these Terms is found invalid or unenforceable, the remainder shall remain in full force.
20. Applicable Law
These Terms are governed by United States and California law without resort to conflict of law provisions.
21. Dispute Resolution
Parties must negotiate in good faith for 60 days. If unresolved, either party may demand mediation in Los Angeles, California. If settlement is not reached within 90 days, unresolved claims proceed to binding arbitration before a single arbitrator in Los Angeles.
Class Action Waiver: Any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor Mass Tort Agency will seek to have any dispute heard as a class action.
